These conditions govern the sale of magazines and other derived products featured on www.burdastyle.uk. The site burdastyle.uk is edited by the company EDITIONS DIPA BURDA, a private company with a capital of 103,665 euros, whose headquarters are located at 26 avenue de l’Europe 67300 Schiltigheim (France), and is registered in the Trade and Companies Register of Strasbourg (France) under the number TI 678 501 511. It is recommended to carefully read these general terms and conditions of sale before using or placing an order on the website. In the event of any questions or difficulties, you can contact us at the address contained in article 8 of these general terms and conditions of sale.

PURPOSE: These general terms and conditions of sale exclusively govern the magazines and other derived products featured on the burdastyle.uk website. These general terms and conditions of sale are concluded for the duration which is necessary for the delivery of the products and/or services. Any order placed on the burdastyle.uk website implies full acceptance of these general terms and conditions of sale. The general terms and conditions of sale are likely to be the subject of subsequent amendments, in which case the general conditions of sale applicable to an order would be those in force on the burdastyle.uk website at the time the order is placed.

CUSTOMER: "Customer" or "you" refers to any physical person having the age of legal majority and at least the legal capacity to conclude a contract who places an order on the burdastyle.uk website according to the indicated prices and conditions.

ORDER: "Order" means the act of purchasing product(s) by a customer on the burdastyle.uk website in accordance with these general terms and conditions of sale.

PRODUCT: "Product(s)" refer(s) to all products offered for sale on the burdastyle.uk website.  

 

ARTICLE 1 - PRICE

1.1 - The prices of our products are indicated in euros VAT included, shipping and handling fees are included for subscriptions in the United Kingdom. Crossed-out prices correspond to the face value of an issue sold at newsstands. The discounted price is calculated in relation to the newsstand price.

1.2 - It is possible to deliver an order containing a subscription / downloadable patterns to any country.

1.3 - Regardless of their origin, orders are payable in euros.

1.4 - EDITIONS DIPA BURDA reserves the right to modify its prices at any time but products will be invoiced based on the rates in force at the time of the order subject to availability. Products remain the property of EDITIONS DIPA BURDA until the price has been fully paid.

1.5 - Current promotions cannot be combined: promo codes, purchase voucher or special discount. Coupons cannot be either exchanged against their monetary value or be fully or partly refunded. Promotional codes are valid for a limited duration. After the indicated time limit, your discount will be permanently lost. Promotional codes are not valid for sales abroad.

ARTICLE 3 - VALIDATION

Before validating your order and making the payment, you will be asked to fully and unequivocally accept these General Terms and Conditions of Sale by ticking a consent box on the summary page of your order.

The data recorded by www.burdastyle.uk forms the proof of all the transactions passed by www.burdastyle.uk and its customers. The data recorded by the payment system forms the proof of the financial transactions. EDITIONS DIPA BURDA will confirm the acceptance of the order at the e-mail address that you have provided. EDITIONS DIPA BURDA reserves the right to cancel any order from a customer with whom a dispute has occurred concerning the payment of a previous order. 

 

ARTICLE 4 - AVAILABILITY

Our product offers are proposed within the limit of the available stocks. Our offers are valid subject to availability from the publisher. In the event a product is not available after placing your order, we will inform you by e-mail or by regular mail as soon as possible. You can then request the cancellation or the exchange of your order:

ARTICLE 5 - DELIVERY

The products are delivered to the delivery address that you specified during the ordering process. The speed of delivery for the is as follows:

 Subscription

 

After your payment, the delivery time for the first issue is:

  • 3 to 4 weeks for daily and weekly publications. Maximum delivery time: 5 weeks.
  • 4 to 6 weeks for monthly publications. Maximum delivery time: 10 weeks.
  • 4 to 12 weeks for quarterly publications. Maximum delivery time: 14 weeks.


These delivery times correspond to the time needed for publisher processing, routing and mailing to the. Once the subscription has started, the magazines are sent periodically at the date of their publication.

Debit card payment

Our website uses a security system to protect all sensitive data related to the payment method as effectively as possible. For the customer’s safety, we have chosen and adopted an SSL encryption (Secure Socket Layer) process which makes the transmitted banking data incomprehensible.

PayPal payment

ARTICLE 7 - SATISFACTION GUARANTEED OR MONEY BACK - WITHDRAWAL RIGHT

7.1 - In the case of a subscription: you have a 14-day withdrawal period after you receive the first issue.

In the case of a purchase of past issues or physical patterns: you have a 14-day withdrawal period after you receive your order.

In the case of a purchase of downloadable products: you have a 14-day withdrawal period, only if you have not yet downloaded the files related to the invoiced product via the download links provided to you after the purchase. Our access rights management system for the downloadable files stored on our server allows us to monitor the number of file downloads for a product.

The terms of withdrawal, in accordance with the provisions of the articles of the European Directive 2001/83 of 25 October 2011, are the following: You must clearly notify (by electronic mail, regular mail or by phone) your decision to terminate the contract.

Compliance with the withdrawal period is guaranteed if the notification is sent before the withdrawal period expires. You will then be refunded no later than within 30 days after the withdrawal right has been exercised. EDITIONS DIPA BURDA can choose to perform the refund either by crediting your bank account or by sending a check paid to the order of the customer’s name who placed the order and sent to the billing address. No cash-on-delivery shipments will be accepted, regardless of the reason.

7.2 - Distance selling: This concerns all possible orders for physical and/or digital press products. This type of product benefits from a legal exception of the withdrawal right in accordance with the provisions of the articles of the European Directive 2001/83 of 25 October 2011. These provisions concern an exception of the withdrawal right for all provisions of newspapers, periodicals or magazines, except for subscription contracts to these publications (see supra). However, in accordance with the commercial uses of the company EDITIONS DIPA BURDA and in the event where you would like to terminate the order and obtain a refund of the products ordered, you must contact the company EDITIONS DIPA BURDA at the indicated address in these terms and conditions within 14 days after receiving the ordered product.

7.3 - With regard to all other products referred to in Article 7.2, you have a period of 14 days to notify your withdrawal after receiving the ordered item, according to the same terms and conditions as referred to in Article 7.1 above, and in accordance with the provisions of Articles L.222-7 and following of the Consumer Code.

ARTICLE 9 - INTELLECTUAL PROPERTY

All texts, comments, journals, illustrations and images reproduced on the burdastyle.uk website are protected under copyright law as well as the intellectual property code for the entire world. As such and in accordance with the provisions of the Intellectual Property Code, only private use is allowed subject to different, and perhaps more restrictive provisions of the intellectual property code. Any other use is an infringement and is punishable under the Intellectual Property Code unless prior authorization has been granted by EDITIONS DIPA BURDA. Any total or partial reproduction of the EDITIONS DIPA BURDA catalog is strictly prohibited. 

 

ARTICLE 10 - LIABILITY

10.1: The proposed journals are in accordance with the Dutch legislation in force. EDITIONS DIPA BURDA’s liability cannot be engaged in case of non-compliance with the legislation of the country where the journals are delivered (prohibition of a title or other). It is your responsibility to check with the local authorities whether the journals that your plan to order can be imported or used. The photographs and texts which are reproduced and illustrate the presented journals are not contractual.

Accordingly, EDITIONS DIPA BURDA’s liability cannot be engaged in case of an error in one of these photographs or one of these texts. EDITIONS DIPA BURDA cannot be held liable for breach of contract in the case of stock shortage or unavailability of the product, force majeure, disruption or a total or partial strike of postal services and means of transport and/or communications, floods, fires. EDITIONS DIPA BURDA will not incur any liability for any consequential damages due to this document, operating loss, profit loss, loss of opportunity, damage or expenses.

10.2: It is also stated that the possible photographs and/or texts appearing on the burdastyle.uk website and illustrating the presented products are not contractual. Accordingly, EDITIONS DIPA BURDA’s liability cannot be engaged in case of an error in one of these photographs or one of these texts. Finally, if a photograph either totally or partially shows a customer or a member of their family, the latter undertakes not to take any legal action, as the photo is published only as an illustration. It can be withdrawn at any time upon simple request addressed to the company EDITIONS DIPA BURDA, in accordance with the provisions applicable in terms of image rights.

ARTICLE 13 - DELIVERY FEES

Shipping is free for any order for a total amount of 20£ or more. For all orders under 18£, shipping and handling fees are 2.50£ per order to the United Kingdom.

Delivery is free for all subscription orders for which the subscriber’s delivery address is in the United Kingdom.

 

ARTICLE 14 - APPLICABLE LAW - DISPUTES

These general terms and conditions of sale are subject to the applicable European regulations as well as Dutch law. The language of these general terms and conditions of sale is the Dutch language. The same is true for all contracts concluded between the company EDITIONS DIPA BURDA and the customer in the framework of orders placed on the burdastyle.uk website. In the event of a dispute, only courts in the Netherlands are competent.
